Can foreigners buy property in Mexico?

Yes — absolutely.
Foreign buyers can own beachfront and coastal properties in Los Cabos, La Paz or Todos Santos through a legal instrument called a Fideicomiso (Real Estate Trust).
This mechanism is fully recognized and protected by Mexican law, granting the same rights of ownership, use, enjoyment, rental, and resale as any Mexican citizen.

What is a Fideicomiso?

Fideicomiso is a trust agreement where a Mexican bank holds the title on behalf of the foreign buyer.
The bank acts as a trustee, while the buyer (the beneficiary) retains all ownership rights:

  • You can use, rent, remodel, or sell the property.
  • You can transfer or inherit it freely.
  • You receive all profits from its use or sale.

In essence, the bank’s name appears on the title, but you have full control and rights over the property.

Why is a trust required?

Mexican law restricts direct ownership by foreigners within 50 km of the coastline or 100 km from the borders — the so-called “restricted zone.”
The Fideicomiso was created by the Mexican Government to allow foreign investment safely within this zone, providing full ownership benefits without legal risk.

Duration and management

  • Term: 50 years, automatically renewable for another 50.
  • Trustee: an authorized Mexican bank (Banorte, BBVA, Scotiabank, Santander, etc.).
  • Annual cost: approximately $500–$700 USD.

The trust is established during the closing process, handled by a public notary and coordinated by your real estate advisor.

Is it safe?

Yes — 100% safe.
Fideicomisos are regulated by the Mexican Ministry of Foreign Affairs (SRE) and the National Banking and Securities Commission (CNBV).
The bank cannot sell, transfer, or use the property without your written consent.
You can also name beneficiaries, ensuring your property passes smoothly to your heirs.
